a job. My father was a general contractor for the New York City Board of Education for over

However, if we file suit, often we can enter a default judgment and freeze bank accounts and
assets so that you get paid. Other circumstances may require further litigation, but either way
my fee in most cases is contingent upon whether I recover the money owed to you.
In addition, you will be more successful if you keep in mind the following:
1. Mechanic's liens are inexpensive and hard hitting. They restrain property or the funding
of public jobs. Do not hesitate to file a lien, as there are strict time limits. My fee to file
a mechanic's liens if $350 + $35 filing fee.
2. Do not let the general contractor tell you that you will get paid when he gets paid. Even
if a "pay-when-paid" clause is in your contract, the New York State Court of Appeals has
held such a clause is void as against public policy and unenforceable.
3. Under New York State Lien Law Section 79-a, once the general contractor gets paid by
the owner, that money is automatically held in trust for the subcontractor. Not paying the
subcontractor may constitute misappropriation of funds and the crime of larceny, for which
the corporation's invidual members, officers, and principals may be liable.
